These Terms & Conditions set out how we work, what you can expect from us, and the responsibilities of both parties when you use our website or instruct Thomas Bradley Residential. Please read them carefully before proceeding. If you have any questions, contact our team and we’ll be happy to help.

Introduction

Effective date: 14 January 2026

These Terms of Business (“Terms”) set out the basis on which Thomas Bradley Residential (“we”, “us”, “our”, “the Agency”), trading style of Thomas Bradley & Co (Scotland) Ltd (Company No. SC595386), provides estate agency services to you (“you” or “the Client”). These Terms apply to all work and services we carry out for you unless expressly agreed in writing by us or a Senior Manager of the Agency.

If work has already begun before you receive these Terms, you agree that these Terms will still apply retrospectively from the date of your initial instruction.

1. Our Services

We provide residential property agency services, including but not limited to:

  • Property valuations
  • Marketing and presentation of properties
  • Facilitating viewings and negotiations
  • Advising on offers and sale terms
  • Assisting with sales progression

These services are delivered in accordance with industry standards, codes of conduct, and best practice applicable in Scotland.

2. Client Instructions

Unless otherwise agreed, instructions must be provided in writing to your named case manager. We may accept verbal instructions at our discretion but such instructions will be confirmed in writing.

3. Office Hours

Our normal business hours are 9:00am to 5:00pm, Monday to Friday (excluding Scottish public holidays). Contact outside these times may be via voicemail, email, or website form, and we will respond within a reasonable timeframe.

4. Client Obligations

You agree to:

  • Provide accurate and complete information about any property you instruct us to sell or value.
  • Supply any documents reasonably required for us to undertake our services.
  • Inform us promptly of any change in your circumstances that may affect our work.

You understand that it remains your responsibility to obtain and provide all statutory reports and documentation required by Scottish property law (e.g., Home Report, Energy Report, Title Information). This Agency is not responsible for circumstances arising from missing or inaccurate statutory documentation unless directly caused by our negligence.

5. Fees and Charges

Our fees and how they are calculated will be agreed in writing before services commence. All fees are exclusive of VAT (where applicable) unless otherwise stated. Fees may include charges for additional services agreed during the course of our engagement.

You agree to pay all fees and charges within the timeframe specified in the service agreement. Late payments may attract interest at a rate permitted by applicable law.

6. Cooling-Off Period & Cancellations

In compliance with the Consumer Contract (Information, Cancellation and Additional Charges) Regulations 2013, you have a 14-day cooling-off period from the day after our initial consultation or the date of your instruction letter, whichever is earlier. Working instructions provided after this period remain valid unless formally cancelled in writing.

Cancellation of services must be communicated in writing (email or signed letter). You remain liable for fees due up to the date of cancellation and any costs reasonably incurred.

7. Termination by the Agency

We reserve the right to terminate services at our discretion if we believe it is appropriate (for example, due to professional conduct issues or failure to provide accurate information). Termination will be effected in writing.

8. Communication

Written correspondence and telephone communications will be responded to promptly within normal business hours. We aim to respond to all time-sensitive enquiries on the same day where possible, but this cannot be guaranteed.

9. Liability and Indemnity

While we shall exercise reasonable skill and care in providing services, we cannot guarantee specific outcomes such as sale price or sale completion dates. To the extent permitted by law, we exclude liability for indirect, special, or consequential losses.

You agree to indemnify us against any liabilities, claims, or expenses arising from false, misleading, or incomplete information provided by you.

Nothing in these Terms shall limit liability for death or personal injury resulting from our negligence, or liability that cannot be excluded by law.

10. Data Protection and Privacy

We collect and process personal data in accordance with applicable data protection laws and our Privacy Policy. By instructing us, you consent to the use of your personal information for the purposes of providing estate agency services, marketing communications (where opted in), and legal obligations. 11. Complaints

We are committed to high standards of service. If you have a complaint, please raise it promptly with our management team. Our complaints process follows requirements of the Property Redress Scheme and aims to investigate and resolve issues thoroughly and fairly.

12. Governing Law

These Terms are governed by and interpreted in accordance with Scots law. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the Scottish courts.

13. Definitions

  • Agency: Thomas Bradley Residential, trading style of Thomas Bradley & Co (Scotland) Ltd.
  • Client: You, the individual or entity instructing the Agency.
  • Terms: These Terms and Conditions (Terms of Business).
